1. Overview of Services: Bard & Bloom Designs Ltd. specializes in creating custom photo magnets, mugs, stickers, tote bags, bookmarks, and other personalized swag. By using our services, you can upload your images and designs for custom product creation.
2. Use of Our Services: You agree to use Bard & Bloom’s services for lawful purposes and in compliance with all applicable laws and regulations. You will not use our services to upload or distribute any content that:
- Infringes on the intellectual property or privacy rights of others.
- Is offensive, defamatory, discriminatory, obscene, or otherwise inappropriate.
- Promotes hate or violence.
We retain the right to refuse service to customers who upload material we find offensive, defamatory, discriminatory, obscene, or otherwise inappropriate.
3. Content Ownership and License: You retain ownership of the images, designs, or content you upload. By uploading content, you grant Bard & Bloom a non-exclusive, royalty-free license to use, reproduce, and modify the content solely for the purpose of creating your custom products. We will use your uploaded content to create your products and then delete your uploaded content once the job is finished.
4. Privacy and Data Protection: Bard & Bloom values your privacy. We do not retain copies of images or designs beyond what is necessary to fulfill your order. Once your order has been successfully delivered, any images or designs you submitted will be permanently deleted from our systems. If you decide to order additional products using the original art or photos, these will need to be resubmitted with the new order. We do not warehouse or store your photos, images, graphics, or designs once your job is completed and delivered. For more details, please refer to our Privacy Policy above.
5. Order Processing and Fulfillment: We strive to process and ship orders in a timely manner. However, fulfillment times may vary based on product availability and order volume. We will provide estimated delivery dates, but please understand that these dates may be subject to change due to unforeseen circumstances. We are shipping from western British Columbia, Canada, so shipping times will vary depending on your location and any job action happening in your local postal carrier and/or chosen shipping company.
6. Refunds and Returns: Due to the custom nature of our products, we do not accept returns or offer refunds unless there is a defect or error caused by us. If you receive a damaged or incorrect item, please contact us within seven (7) days of receiving your order, and we will work with you to resolve the issue.
We understand items can be damaged during the shipping process and to mitigate this risk, we package and ship your items with utmost care using sturdy packing materials. If a mug arrives broken, please take a photo right away of the damaged item and we will quickly dispatch a replacement product. 7. Intellectual Property: All content, designs, and trademarks on the Bard & Bloom website, excluding user-submitted content, Creative Commons and/or public domain content, and content appropriately licensed from third-party suppliers and/or artists, are the property of Bard & Bloom and are protected by intellectual property laws. Unauthorized use is strictly prohibited.
